Dark Shot Photo Competition

In order to showcase the extraordinary nature of our night skies we are calling on all photographers to submit their best Southland night sky images!

A selection of the best of these will be exhibited during the Matariki Festival and one overall winner will be announced, receiving flights for two and a night’s accommodation to the land of the glowing skies – Rakiura/ Stewart Island. Staying at the luxurious Observation Rock Lodge, the winner will have panoramic views across Paterson Inlet and experience a Real Journeys Kiwi Encounter in the evening.

Entries close at 5pm on the 22nd June. The overall winner will be announced during the ‘Seeing Stars’ evening event on Wednesday 4th July.

  • 1. Definitions
  • 1.1 In these terms and conditions the following words have the meanings set out below:

‘Disqualified Participants’ means all employees of the Promoter, the Prize providing company and their immediate families, and any other person disqualified pursuant to the Specific Terms and Conditions.

‘Eligible Participants’ means everyone except for the Disqualified Participants.

‘Entry’ means any entry to a Promotion submitted by a Participant in accordance with the Standard Terms and Conditions for Promotions and includes (without limitation) photographs, videos, digital media, drawings, audio and literary works, and ‘entries’ has a corresponding meaning.

‘Participant’ means the Disqualified Participants and Eligible Participants.

‘Prize’ has the meaning set out in Schedule 1.

‘Promoter’ means Venture Southland, 143 Spey Street, PO Box 1306, Invercargill, Southland.

‘Promotion’ means the Promoter’s competition and/or promotion through any means of medium including but not limited to online (including social media), radio and print and more particularly described in the Specific Terms and Conditions.

‘Prize Winner’ means the person who wins the Promotion.

‘Redemption Period’ means the period within which the Prize may be redeemed, as specified in the Specific Terms and Conditions.

‘Specific Terms and Conditions’ has the meaning set out in clause 7.1.

  • 2. Entry
    • 2.1 By entering the Promotion you confirm that you accept and agree to these terms and conditions, and any Specific Terms and Conditions. If the Prize Winner does not accept this clause 2.1 the Prize will be forfeited.
  • 3. Personal Information
    • 3.1 The Promoter will specify in the Specific Terms and Conditions the contact details Participants must supply.
    • 3.2 The Promoter may use the contact details supplied by all Participants for further marketing contact by the Promoter. Participants may opt out of further marketing contact, by emailing the Promoter at info@venturesouthland.co.nz
    • 3.3 The Promoter reserves the right to seek and to verify any information provided by the Prize Winner, including (without limitation) as to any eligibility requirements for the Promotion.  Entries which do not contain clear or valid information will be deemed invalid at the Promoter’s sole discretion.
    • 3.4 All Participants acknowledge and consent to the use of their personal (and where applicable business) information including but not limited to photographs being taken and published on any form of media (without limitation, this includes print, social media, and radio) in connection with the Promotion and for future promotion and marketing purposes. The Participant waives any claims to royalty, right or remuneration for such use. Where the Participant is under the age of 18 the consent of the Participant’s parents or guardians will be obtained by the Promoter before using that Participant’s personal information.
    • 3.5 Pursuant to the Privacy Act 1993 all Participants have the right to access and correct their personal information by contacting the Promoter in writing. Personal information will be dealt with by the Promoter in accordance with its Privacy Policy, available here.
  • 4. Publicity
    • 4.1 The Promoter may publicise the Promotion and Participants in any manner they think fit.
    • 4.2 The Prize Winner by accepting the prize agrees to be available for publicity purposes without compensation, including photographs and interviews, during reasonable hours.
  • 5. Promoter’s Prerogative
    • 5.1 The Promoter takes no responsibility for any lost, damaged, misdirected, late, or illegible entries or any problems or technical malfunctions which may result in delay or failure to enter in the Promotion, or prevent the Participant from being the Prize Winner. The Promoter takes no responsibility for incorrect transcription of information, or for any human error, lost/delayed data transmission, omission, or any other error or malfunction in relation to the Promotion.
    • 5.2 The Promoter will select the Prize Winner from the Eligible Participants in their sole discretion. If the Promoter is unable to contact the Prize Winner within 1 week, having made reasonable efforts to do so, that Prize Winner’s entry will be declared invalid and the Promoter reserves the right at its absolute discretion to select a new winner from the Eligible Participants.  To avoid doubt the Promoter shall not be required to locate any additional contact details for the Prize Winner than those provided upon entry. This clause may apply more than once.
    • 5.3 The Promoter reserves the right to add any person to the Disqualified Participants definition during the Promotion on reasonable grounds.
    • 5.4 The Promoter reserves the right to change these terms and conditions, and the Specific Terms and Conditions (including the Redemption Period) without prior notice at any time.
  • 6. Prize
    • 6.1 The Prize can only be won by an Eligible Participant (as determined by the Promoter in its sole discretion).
    • 6.2 The Prize is as listed at Schedule 1. Any other costs including but not limited to transport, meals, insurance and tax are the responsibility of the Prize Winner.
    • 6.3 The Promoter reserves the right to exchange the Prize for a prize of a similar value at the Promoter’s sole discretion. 
    • 6.4 The Prize Winner cannot transfer the Prize to another person without the prior written consent of the Promoter.
    • 6.5 The Prize cannot be transferred, exchanged or redeemed for cash.
    • 6.6 If the Prize Winner is under 18 years of age, the prize will be awarded to the Prize Winner’s parent or caregiver.
  • 7. Promoter’s Liability
    • 7.1 The Promoter, its employees and agents, will not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever suffered (including indirect or consequential loss) or for any loss or damage or personal injury suffered or sustained in connection with the Promotion or the Prize. Further, the Promoter takes no responsibility for any Prize that is not supplied by a third party, lost or destroyed.
  • 8. Specific Terms and Conditions
    • 8.1 A Promotion may have specific terms and conditions which will be included in Schedule 1 attached (the “Specific Terms and Conditions”). The specific terms and conditions will prevail over these standard terms and conditions in the event of any inconsistency.
  • 9. Facebook / Social Media
    • 9.1 The Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook and/or other social media channels. By entering this promotion you are providing this information to the Promoter and not to Facebook or other social media channels. You completely release Facebook and/or other social media channels from any and all liability associated with this Promotion.
  • 10. Travel
    • 10.1 Any changes to travel dates or additional accommodation outside the travel period specified in the Prize details in the Specific Terms and Conditions, made by the Prize Winner, which incur additional costs, are to be paid by the Prize Winner.
    • 10.2 Incidental costs, including but not limited to passport and visa costs, travel insurance, departure taxes and airport transfers and all other personal expenditures will be at the Prize Winners expense unless specifically advised in the Prize.
    • 10.3 When the Prize Winner is under 18 years of age, they must be accompanied by a parent or guardian over the age of 18. The Promoter shall not be responsible for any travel costs incurred by the parent or guardian.
  • 11. Activities and accommodation
    • 11.1 Where the Prize includes activities and accommodation, such activities and accommodation are subject to availability and seasonal changes in scheduling. Without limiting clause 6, where such activities are weather dependent the Promoter and the provider of the Prize reserve the right to change or modify the Prize or the Redemption Period.
    • 11.2 The Prize Winner agrees it will be bound by the terms and conditions of each provider of the Prize or part thereof, once the Prize is booked and confirmed.

Schedule 1 - Specific Terms and Conditions

These specific terms and conditions apply to the Dark Skies/Matariki Festival ‘Dark Shot’ competition via promoted via Paper/Radio & Social Media through SouthlandNZ.com.

Promotion Period

  • A. The Promotion commences at 12pm on 7 June 2018 and ends at 5pm on 22 June 2018. The Promoter reserves the right to change the promotion period at any time at their sole discretion.

Prize

  • B. The Prize is
    • 2 x Flights from Invercargill to Stewart Island and return to Invercargill
    • One Night Accomodation at Observation Rock Lodge
    • 2 x Wild Kiwi Encounter
    • Redemption dates to be determined on contact with Prize Winner but within Redemption Period.

Entry

  • C. The participant must (as instructed within the post), upload their image via SouthlandNZ.com by 5PM on 22 June and follow the on-screen instructions carefully.
  • D. Images must be taken in the Southland region.
  • E. Images should be no smaller than 1MB and no larger than 8MB. Images should be JPEG files.
  • F. Entries will be judged between June 23, 2018 and June 30, 2018.
  • G. You may enter as many times as you like. Judging will be based on the single image and not the series of images. The Promoter’s decision as to the Prize Winner is final.
  • H. Venture Southland reserves the right, in its sole discretion, to disqualify and remove any entry that does not comply with the following requirements, even after the entry is submitted on the Website. You warrant and represent, in respect of each entry submitted by You (“Entry”), as follows:
    • H.1. You are the sole owner and author of each Entry
    • H.2. You have the right to make Your Entry available to the Competition
    • H.3. Each Entry does not contain personally identifiable information about You or any other person(s)
    • H.4. Each Entry does not contain any infringing, threatening, false, misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content
    • H.5. Each Entry does not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law
    • H.6. Each Entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity including:
      • H.6.1 trademarks owned by third parties
      • H.6.2 copyrighted materials owned by third parties (including movie dialogue or musical compositions)
      • H.6.3 names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead
    • H.7. Entries which contain any commercial content that promotes any product or service other than that of Venture Southland.
    • H.8. Entries containing screen credits
    • H.9. No animals were harmed or manipulated in the making of the image
  • G. You agree to fully indemnify Venture Southland in respect of all royalties, fees and any other monies owing to any person by reason of Your breaching any of the foregoing.
  • I. You confirm that each person depicted in the Entry has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained.
  • J. All decisions are at the discretion of the Promoter and no correspondence will be entered into in this regard.
  • K. If you are under 16, you have your parent’s or legal guardian’s consent to participate in the Competition.
    • K.1. If Venture Southland does not receive a valid signed parental or legal guardian consent form for any winner under the age of 16 within 7 clear days of the Entrant being declared a winner (excluding the day on which such declaration is made by Venture Southland) Venture Southland will be entitled to select an alternative winner from among the Entrants.
  • M. Venture Southland recognises You, the author of the image, retain full ownership of the copyright in each Entry.
  • N. All Entrants understand that any image submitted to the competition may be used by Venture Southland, and its Event Partners, for marketing and promotional purposes of You the author and the event only. You hereby grant Venture Southland a non-exclusive, irrevocable licence in each Entry in all media for any use connected to the promotion of You the author and Dark Skies/Matariki Festival event and/or competition, including, but not limited too:
                (a) inclusion within the Website, or Social Media of SouthlandNZ, Invercargill City Council of Invercargill i-SITE Visitor Information Centre

(b) inclusion within any materials promoting Dark Skies in the promotion of the Southland Region.

  • O.  Venture Southland assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Competition, and the Venture Southland assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Competition. Venture Southland assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of Entries. Venture Southland is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to Venture Southland on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to Your or any other person's computer related to or resulting from participation or downloading any materials in the Competition. If for any reason a contestant’s entry cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, Venture Southland assumes no responsibility.
  • P. In no event will Venture Southland, its parents, affiliates, subsidiaries and related companies, or its officers, directors, employees, shareholders, representatives or agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any Entrant’s access to and use of the Website. Without limiting the generality of the foregoing, everything on the Website is provided "as is", without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose or use or non-infringement.
  • Q. You agree to participate in related publicity and to the use of Your name and likeness for the purposes of advertising, promotion and publicity without additional compensation.
  • R. All Entrants must be able to supply a high resolution image suitable for printing in media and an exhibition should the image be required.

Disqualified Participants continued

  • T. The following people are also disqualified from participating in the Promotion:
    • Any person who resides outside of New Zealand.

Prize Draw and Announcement

  • U. The Prize winner will be selected from the valid entries and announced between 7pm and 9pm on Wednesday 4th July during the ‘Seeing Stars’ Dark Skies Matariki speaking event. If not present the winner will be notified by phone and/ or email the following day.

Redemption Period

  • V. The Redemption Period for the Prize is one year (12 months) from the date of the announcement of the Prize Winner. Flights and Accommodation need to be redeemed as a package.
